These Terms of Service ("Terms") constitute a legally binding agreement between you and Flux Kontext AI ("we," "our," or "us") governing your access to and use of the FluxKontext AI-powered image editing and generation platform, website, applications, and services (collectively, the "Service"). By accessing or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

1. Service Description

Flux Kontext AI is an AI-powered service that provides advanced image editing and generation capabilities using state-of-the-art artificial intelligence models. Our Service allows users to upload images, apply AI transformations, generate new images from text prompts, and manage their creative content securely.

2. Account Requirements and Eligibility

2.1 Age Requirement: You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that you are at least 18 years old.

2.2 Account Registration: To access certain features of the Service, you must create an account by providing a valid email address and creating a secure password. You agree to provide accurate, current, and complete information during registration.

2.3 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Intellectual Property and Content Rights

3.1 Your Content Ownership: You retain ownership rights to any original images you upload to our Service. By uploading content, you grant us a limited license to process, store, and display your images solely for the purpose of providing our Service to you.

3.2 Generated Content: Images generated through our AI models are provided to you under a non-exclusive, worldwide license for both personal and commercial use, subject to the content restrictions outlined in Section 4.

3.3 Service Technology: The Flux Kontext AI platform, including all software, algorithms, AI models, website design, and underlying technology, is owned by Flux Kontext AI and protected by intellectual property laws. Nothing in these Terms grants you ownership rights to our Service technology.

3.4 Privacy Commitment: We will never share, display publicly, or use your uploaded or generated images for marketing purposes without your explicit written consent. Your creative content remains private and under your control.

4. Prohibited Content and Conduct

You agree not to use the Service to create, upload, or generate content that:

  • Is Illegal: Content that violates any applicable laws, regulations, or promotes illegal activities.
  • Depicts Violence: Content that depicts, promotes, or glorifies violence, physical harm, or cruelty.
  • Is Sexually Explicit: Pornographic, sexually explicit, or adult content is strictly prohibited.
  • Involves Minors: Any content depicting or purporting to depict individuals under 18 years of age.
  • Is Harassing or Discriminatory: Content that harasses, intimidates, or discriminates based on protected characteristics.
  • Infringes Rights: Content that violates intellectual property rights, privacy rights, or other legal rights of third parties.
  • Is Deceptive: Content designed to deceive, mislead, or defraud others, including deepfakes for malicious purposes.
  • Contains Hate Speech: Content promoting hatred, violence, or discrimination against individuals or groups.

Additionally, you agree not to:

  • Use automated tools, bots, or scripts to access the Service without explicit authorization.
  • Attempt to reverse engineer, hack, or compromise the security of our Service.
  • Share account credentials or allow unauthorized access to your account.
  • Interfere with the proper functioning of the Service or related infrastructure.
  • Collect or harvest other users' personal information.

5. Subscription Plans and Billing

5.1 Plan Structure: We offer various subscription plans that provide different monthly generation limits while maintaining the same high-quality AI models and features across all plans.

5.2 Billing Cycles: Subscriptions are available on monthly or annual billing cycles. Annual subscriptions typically provide cost savings compared to monthly billing.

5.3 Automatic Renewal: Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date. You authorize us to charge your payment method for the applicable subscription fee.

5.4 Cancellation: You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to premium features until the end of your current billing period, after which your account will revert to any available free tier.

5.5 Payment Terms: All payments are due immediately upon subscription or renewal. We reserve the right to suspend access to premium features for accounts with overdue payments.

5.6 Refund Policy: Payments are generally non-refundable. We may, at our sole discretion, provide refunds in exceptional circumstances such as technical issues preventing service use.

5.7 Price Changes: We reserve the right to modify subscription pricing with at least 30 days' notice to existing subscribers. Price changes will take effect at the start of your next billing cycle.

6. Content Moderation and Safety

6.1 Automated Filtering: We employ advanced content filtering systems to prevent the generation of prohibited content. These systems are continuously improved but are not infallible.

6.2 User Responsibility: If you receive generated content that violates these Terms, you must report it immediately and refrain from using, saving, or sharing such content.

6.3 Reporting Mechanism: Users can report inappropriate content or Terms violations to report@Flux Kontext AI.pro. We investigate all reports promptly and take appropriate action.

6.4 Enforcement Actions: We reserve the right to:

  • Remove or refuse to process content that violates these Terms.
  • Suspend or terminate accounts for Terms violations.
  • Report violations to appropriate authorities when required by law.
  • Take any other action necessary to protect our Service and users.

7. Service Availability and Support

7.1 Service Availability: We strive to provide reliable service availability but do not guarantee uninterrupted access. The Service may occasionally be unavailable due to maintenance, upgrades, or technical issues.

7.2 Customer Support: We provide customer support through email and our help documentation. Support response times may vary based on volume and complexity of inquiries.

7.3 Service Modifications: We reserve the right to modify, update, or discontinue features of the Service with reasonable notice to users when possible.

8. Disclaimers and Limitations

8.1 No Guarantees: Flux Kontext AI does not warrant that the Service will be error-free, secure, or available at all times. We do not guarantee specific results from AI generation processes.

8.2 Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, Flux Kontext AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICE.

8.3 Liability Cap: Our total liability to you for all claims shall not exceed the amount you paid for the Service in the six months prior to the claim, or $100, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless Flux Kontext AI and its officers, directors, employees, and agents from any claims, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

10. Termination

10.1 Termination by You: You may terminate your account at any time by contacting our support team or using account deletion features when available.

10.2 Termination by Us: We may suspend or terminate your access to the Service at any time for violation of these Terms, non-payment, or other legitimate business reasons.

10.3 Effect of Termination: Upon termination, your access to the Service will cease immediately. We may retain your data for a reasonable period to comply with legal obligations or resolve disputes.

10.4 Data Deletion: Upon account deletion, we will permanently delete your personal information and images from our systems within 30 days, except as required for legal compliance.

11. Modifications to Terms

We may modify these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. We will notify users of material changes via email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

12. Governing Law and Disputes

12.1 Governing Law: These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles.

12.2 Dispute Resolution: Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules.

12.3 Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class actions or collective proceedings.

13. General Provisions

13.1 Severability: If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

13.2 Entire Agreement: These Terms, together with our Privacy Policy, constitute the complete agreement between you and Flux Kontext AI regarding the Service.

13.3 Assignment: You may not assign these Terms without our written consent. We may assign these Terms to any successor or affiliate.

13.4 Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
